Judge stands by decision on police jurisdiction

Charlottesville Circuit Judge Paul M. Peatross declined to reconsider a decision to dismiss two felony assault charges against Josue Salinas Valdez, who was shot in May in an altercation with Albemarle County police.

Peatross dismissed the charges last week, ruling that the county officers, who had crossed into the city to investigate a hit and run, were not responding to “an emergency involving any immediate threat to life or public safety.”

Peatross told prosecutors last week they could refile assault charges on Valdez, but said they could not seek enhanced penalties associated with assault on an officer.

Valdez also faces a drunk driving charge and a felony failure to stop at the scene of an accident.
