Bill would let lawmakers defend ban if AG refuses

Attorney General Mark R. Herring's announcement that he deems Virginia's same-sex marriage ban unconstitutional may be a first milestone in his tenure as the state's chief lawyer, but Republican lawmakers say that it was hardly surprising.

"Candidate Herring signaled very clearly that there would be areas where he would choose not to defend certain things in court, and we all surmised that he meant the very thing that he has now done," Del. C. Todd Gilbert, R-Shenandoah, said Thursday.
