A Staunton grand jury on Monday indicted Alan Dale Bartley, 57, of Staunton, on charges of murdering his girlfriend’s son.
Authorities said Bartley shot and killed 32-year-old Anthony Scott Moore during a domestic dispute on Oct. 28. He faces charges of first-degree murder, use of a firearm in commission of a felony, two counts of malicious wounding and non-violent felon in possession of a weapon.
Staunton police said they responded to Campbell Street to find Bartley being held by neighbors in the front yard.
Shot during the dispute, Bartley’s girlfriend, Cynthia Fitzgerald, 56, testified the fight began at about 8 p.m. after Bartley unsuccessfully searched for his rifle. He asked Fitzgerald and her two sons about the gun again and again, unable to let the topic go, she testified.
Angry about Bartley’s persistence, Moore ordered the man to “shut up,” which sent him into a rage, Fitzgerald said. Bartley fired at least three shots, authorities said. One hit and killed Moore.
The grand jury also indicted:
• Carrie Ann Massie, of Mount Sidney, on six charges of credit card fraud. Deputies arrested Massie in November 2010. Authorities said Massie was using the credit cards illegally as early as August.
• Michael Edward Phillips, 55, of Staunton, on charges of attempted rape and two counts of object sexual penetration. Authorities charged Phillips Jan. 16, the same day his victim alleged the attack.
